BY ENTERING THE PROMOTION, YOU AGREE TO RELEASE INSTAGRAM AND FACEBOOK AND ANY OTHER SOCIAL MEDIA SITE USED IN CONNECTION WITH THE PROMOTION FROM ANY POTENTIAL LIABILITY IN CONNECTION WITH YOUR ENTRY AND PARTICIPATION IN THE PROMOTION.

Sponsor and Administrator: The Dramamine® What To Pack Giveaway (the “Promotion”) is sponsored and administered by Medtech Holdings, Inc., a Prestige Brands company (“Sponsor/Administrator”), 660 White Plains Road, Tarrytown, NY, 10591. This Promotion is in no way sponsored, endorsed, or administered by, or associated with, Instagram or Facebook.
Eligibility: The Promotion is open only to legal residents of the United States who are at least eighteen (18) years old. Residents of the European Union are not eligible to enter. Employees of Sponsor/Administrator or its affiliated companies, as well as the immediate family (spouse, parents, siblings, and children and their respective spouses) and household members (those living in the same home whether or not related) of those employees, or of any of their respective distributors, vendors, service agencies and companies involved in the design, implementation and execution of the Promotion (the “Promotion Entities”), are not eligible to enter.
Agreement to Official Rules: By entering the Promotion, you indicate your full and unconditional agreement to, and acceptance of, these Official Rules and Sponsor/Administrator’s decisions, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Entry Period: The Promotion begins at 12:01 AM Eastern Time (“ET”) on March 13, 2023 and ends at 11:59PM ET on March 31, 2023 (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Sponsor/Administrator’s computer is the official time-keeping device for the Promotion.
How to Enter: Visit Sponsor’s Facebook page at https://www.facebook.com/DramamineOfficial/ or the Sponsor’s Instagram page at https://www.instagram.com/DramamineOfficial/, and follow the directions to respond in a comment to Sponsor’s post on Facebook or Instagram. There is a limit of one (1) entry per person across social platforms and you may not use multiple Instagram or Facebook accounts to enter. The use of an agency or any automated system to enter is strictly prohibited, and Sponsor/Administrator reserves the right to disqualify any entries received through such methods, as determined by Sponsor/Administrator, in its sole discretion. Sponsor/Administrator reserves the right to void an entry for any reason, in its sole discretion.
Drawing: Within two to three (2-3) days of the end of the Entry Period, the Sponsor/Administrator will select five (5) potential winners out of all eligible entries received, based on Sponsor/Administrator’s determination, in its sole discretion, of the comment to Sponsor’s post on Facebook or Instagram.
Notification and Requirements of Potential Winner: Sponsor/Administrator will attempt to notify the potential winner within two to seven (2 - 7) business days of the selection of the potential winner by replying directly to the comment the potential winner used to enter. If a potential winner does not respond within two (2) business days after Sponsor/Administrator replies, or as directed by Sponsor/Administrator, an alternate potential winner may be selected in his/her place in the manner described in Section 6 above from the remaining eligible entries received. Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release. If a potential winner fails to sign and return these documents within the required time period, an alternate potential winner may be selected in his/her place in the manner described in Section 6 above from the remaining eligible entries received. Only three (3) alternate potential winners may be contacted for the prize.
Prize: Five (5) winners will each receive one (1) What To Pack Prize Pack, including Dramamine Product, a water bottle, hat, tote bag, towel, and an Apple Air Tag. The approximate retail value (“ARV”) of the prize is $120. A winner is responsible for paying any applicable income taxes and any and all other costs and expenses not listed above. Any prize details not specified above will be determined by Sponsor/Administrator, in its sole discretion. The right to receive the prize may not be transferred and must be accepted as awarded. A winner may not request cash or a substitute prize; however, Sponsor/Administrator reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor/Administrator, in its sole discretion.
General Conditions: In the event that the operation, security, or administration of the Promotion is impaired in any way, Sponsor/Administrator may, in its sole discretion, either (a) suspend the Promotion to address the impairment and then resume the Promotion; or (b) award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor/Administrator reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Promotion, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Sponsor/Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor/Administrator shall not be deemed proof of receipt of that communication. In the event of a dispute as to the owner of an online entry, the authorized account holder of the Instagram or Facebook account used to enter will be deemed to be the owner. The Promotion is subject to federal, state, and local laws and regulations and is void wherever prohibited or restricted by any laws or regulations.

By submitting an Entry, each Entrant represents and warrants as follows: (i) Entrant has the full and exclusive right, power and authority to submit the Entry and to grant Sponsor/Administrator and the Promotion Entities the right to present the Entry to the public without further compensation; (ii) no rights in the Entry have been previously granted to any other person, firm, corporation or entity; (iii) the Entry does not contain any computer viruses and is otherwise uncorrupted; (iv) the Entry does not and will not violate these Official Rules or any applicable federal, state or local laws or regulations. Entrant herby agrees to indemnify Sponsor/Administrator and the Promotion Entities and any licensee of Sponsor/Administrator against all claims, damages, liabilities and expenses (including attorneys’ fees and legal expenses) arising out of any breach or alleged breach of these representations and warranties.

Release and Limitations of Liability: By participating in the Promotion, you agree to release and hold harmless Sponsor/Administrator, the Promotion Entities, Instagram, Facebook, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of your participation in the Promotion or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail or email; (e) errors in the administration of the Promotion or the processing of entries; or (f) injury or damage to persons or property. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Privacy and Publicity: Any information you provide when you enter the Promotion will be subject to Sponsor/Administrator’s Privacy Policy. Except where prohibited by law, participation in the Promotion constitutes your consent to Sponsor/Administrator’s use of your submission content, name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media now known or hereafter discovered, worldwide in perpetuity, without notice or approval, and without further payment or consideration.
Disputes: You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state court located in Westchester County, New York. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor/Administrator in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of New York, without giving effect to any choice of law or conflict of law rules (whether of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New York.
Winner’s List: To obtain a copy of these Official Rules or a winner’s list via mail, please mail your request, together with a self-addressed, stamped envelope, to: Dramamine® c/o Medtech Holdings, Inc., 660 White Plains Road, Suite 250, Tarrytown, NY 10591. Only one (1) request per envelope. Requests received 30 or more days after the end of the Entry Period will not be honored.
